MISLEADING: SC junks petition validating 12-senator quorum 

A high school teacher moved to declare the Senate session held on June 3, 2026, as constitutional.

CLAIM:

The Supreme Court dismissed John Barry Tayan’s petition to declare that the 12-senator quorum of the 20th Congress on June 3, 2026, was legally valid and binding.

RATING: MISLEADING

CONCLUSION:

The Supreme Court did dismiss Tayan’s bid to seek the legal validation of the 12-senator quorum, as well as his request for a constitutional ruling on what happened during the said Session, where various legislative actions, vacancy declarations, and committee reorganizations took place.

However, the SC did not directly rule on the validity or invalidity of the 12-senator quorum itself. Instead, it dismissed Tayam’s petition for failing to establish a legal standing, ruling that he failed to demonstrate that he personally suffered from the Senate’s actions during the said session.

THE FACTS:

  • In June 3’s Senate session, only 22 senators remained within the jurisdiction of the Senate, meaning 2 were out of reach due to Sen. Ronald ‘Bato’ dela Rosa being in hiding and Sen. Jinggoy Estrada being detained.
  • Within the 22 senators remaining, 10 were absent, and only 12 members were present in June’s Senate session. An absolute majority of 12 out of 22 members constituted a quorum.
  • Win Gatchalian was elected as Senate President pro tempore after establishing the quorum and upheld the Supreme Court’s ruling in the case of Avelino v. Cuenco, where the presence of 12 out of 22 members makes up a legally valid quorum. 
  • In the said session, committees were reshuffled, where Sen. Erwin Tulfo replaced Sen. Pia Cayetano as chairman of the Blue Ribbon Committee. 
  • Tayan’s petition to validate June 3’s Senate session was junked because he himself failed to prove that he ‘suffered, or was at imminent risk of suffering, any direct injury from the actions he challenged.’
